Resumo: O presente artigo tem por objetivo analisar o julgamento da Ação Direta de
Inconstitucionalidade - ADI 4.901/2013-DF- que considerou a Lei 12.651/2012 (Novo
Código Florestal) constitucional, tendo como ponto polêmico a redução das Áreas De
Reserva Legal (RLs) e o Projeto de Lei nº 2.362/2019, que extingue a Reserva Legal e seus
potenciais impactos, à luz do artigo 225 da Constituição Federal de 1.988. Foi utilizada
metodologia jurídico-teórica e raciocínio hipotético-dedutivo com técnicas de pesquisa
bibliográfica sobre a temática. Os resultados esclarecem que o Tribunal desconsiderou o
parecer científico do texto constitucional, em seus vários ramos e a trajetória do
ordenamento jurídico vigente, pelo Projeto de Lei 2.362/2019, foi desconsiderada.
Constatou-se diminuição significativa na proteção da Reserva Legal em relação à antiga lei,
e a extinção da Reserva Legal, se aprovado o Projeto, trará significativo impacto potencial
ao ecossistema como um todo, em toda sua biodiversidade e equilíbrio.

Abstract: The present article aims to analyze the judgment of the Direct Action of
Unconstitutionality (ADI 4,901 / 2013-DF), which considered Constitutional Law 12,651 /
2012 (New Forest Code), having as a polemic point the reduction of Legal Reserve Areas
(RLs) and Bill 2362/2019, which extinguishes the Legal Reserve and its potential impacts,
in light of Article 225 of the Federal Constitution of 1988. Legal-theoretical methodology
and hypothetical-deductive reasoning were used with bibliographic research techniques on
the subject. The results clarify that the Court disregarded the opinion, in its various
branches, already positive in the constitutional text and the trajectory of the current legal
system, by Bill 2,362 / 2019, was disregarded. There was a significant decrease in the
protection of the Legal Reserve in relation to the old law, and the extinction of the Legal
Reserve, if approved, will have a significant potential impact on the entire ecosystem, in all
its biodiversity and balance.
