RESUMO: Com o advento da Lei nº 13.465 de 11 de julho de 2017, foi apresentado
ao nosso ordenamento jurídico uma nova espécie de direito real: o Direito real de laje.
Recebido com certa resistência da doutrina, entende-se necessário seu estudo, assim
como sua diferenciação dos demais direitos reais já existentes. E é o que se busca com
o presente artigo. Não tendo o escopo de aprofundar-se no tema, mas apenas introduzir
o estudo, indicando algumas teorias e temas polêmicos que estão sendo levantados, e
mencionando também uma recente decisão em que foi reconhecido judicialmente
o direito real de laje. A pesquisa se utilizou da dogmática e do método indutivo,
confrontando as legislações existentes ao novo diploma legal e consultando a doutrina e
a jurisprudência recentes no tema.

AbSTCT: e law number 13.465, from July 11, 2017, presented to our legal order
a new category of real estate right: the property right over superelevation buildings.
It was initially taken with a high degree of resistance and raised intense discussions
between our doctriners. erefore the subject demands a deep study, mainly about the
dierences from the other kinds of real estate rights already dened. at is the purpose
of this paper, which scope doesn’t include a complex analysis, but an overview of the
maer and also identify some theories and controversial topics that have been raised.
Also a real world example with a full recognition of property rights of a superelevated
property by the our legal system. e research used dogmatics and the inductive method,
comparing the existent laws to the new legal diploma and utilizing the recent doctrines
and jurisprudences to the maer.
