RESUMO: A família é base da sociedade não importando como e por quem é constituída,
sendo essa a interpretação da Constituição Federal de 1988 de maneira a garantir proteção as
entidades familiares e seus membros. A união estável em sua essência constitui das mane iras
mais simples de formar família, pois não carece de qualquer interferência estatal para sua
constituição e desfazimento, excepcionando situações em que gerem conflitos, quando, por
exemplo, surge como centro da discussão a disputa pelo animal de estimação. O trabal ho tem
como problema de partida analisar a guarda responsável dos animais de estimação diante do
rompimento da união estável. Justifica-se pela necessidad e de dirimir situações que não
encontram enquadramento legal correspondente, carecendo de inter pretação civil-
constitucional ao caso concreto. Por sua vez, o objetivo é o de investigar a possibilidade de
aplicação das normas referente ao exercício da guarda responsável em relação ao animal de
estimação enquanto membros da família quand o da dissolução da união estável. Em relação
ao método, houve aplicação do dedutivo a partir da observação de enunciados gerai s para a
obtenção de uma conclusão específica, uso pesquisa bibliográfica de natureza qualitativa e do
método histórico como auxiliar. Por fim, tem-se a possibilidade de aplicação da ideia de
guarda responsável de humanos aos animais de estimação quando da dissolução da união
estável.

ABSTRACT
The family is the ba sis of society regardless of how and by whom it is constituted, this being
the interpretation of the Fed eral Constitution of 1988 in or der to guarantee pr otection for
family entities and their members. Stable union in its essence constitutes the simplest ways to
form a family, as it does not lack any state interference for its constitution and dissolution,
excepting situations in which they generate conflicts, whe n, for exa mple, the di spute for the
pet appears at the center of the discussion. pet. The starting point of the work is to analyze the
responsible custody of pets in the face of the br eakup of the common-law marriage. It is
justified by the need to resolve situations that do not meet the corresponding legal framework,
lacking a civil-constitutional interpretati on of the specific case. In turn, the objecti ve is to
investigate the possibility of applying the rules regarding the exer cise of responsible custody
in relation to the pet as f amily members upon the dissolution of the common-law marriage.
Regarding the method, there was application of the deductive from the observation of general
statements to obtain a specific conclusion, I use bibliographic research of a qualitative nature

and the historical method as an auxiliary. Finally, there is the possibility of applying the idea
of responsible human custody to pets when t he common-law marriage is dissolved.
