RESUMO: O presente artigo tem o objetivo de discutir a relação entre
democracia e direitos humanos na perspectiva da pedagogia do oprimido
formulada por Paulo Freire, tomando como contexto as polêmicas recen-
temente suscitadas em relação ao 3º Programa Nacional de Direitos Hu-
manos (PNDH-3) e ao Plano Nacional de Educação em Direitos Huma-
nos (PNEDH). Para isso, evidencia-se inicialmente o caráter político dos
direitos humanos, e sua impossível neutralidade dentro de uma sociedade
complexa e organizada em classes e grupos sociais com interesses muitas
vezes diretamente antagônicos entre si. À luz do instrumental teórico for-
necido por Karl Marx, são analisados os limites e as possibilidades dos

direitos humanos dentro da sociedade capitalista vigente, especialmente
no que tange aos povos oprimidos da periferia do atual sistema-mundo.
É justamente dentro dessa perspectiva geopolítica que se encontra a peda-
gogia freireana, cujas características essenciais e diferenças fundamentais
em relação a outras matrizes político-epistemológicas são identif‌icadas, de
forma a contribuir para a construção de uma educação em direitos huma-
nos baseada na alteridade latino-americana.

ABSTRACT: e article discuss the relation between democracy and
human rights in the perspective of the pedagogy of the oppressed made by
Paulo Freire, taking as context the recent controversies around 3rd National
Program for Human Rights (PNDH-3) and the Plan national Human
Rights Education (PNEDH). For this, it shows initially the human rights
as political construction, and the impossibility of its neutrality in a complex
society, witch is organized into classes and social groups with interests often
directly antagonistic. Inspired by the theory of Karl Marx, it analyzes the
limits and possibilities of human rights in the existing capitalist society,
especially in the case of the oppressed peoples in the periphery of the current
world system. It is precisely in this geopolitical perspective that is builded
the pedagogy of Freire, wich the essential characteristics and fundamental
dif‌ferences in relation to other political and epistemological teories are
identif‌ied in order to contribute to building a human rights education based
on the Latin American otherness.
