This article, on a general level, aims to discuss the customs relevance as an effective method for solving regulatory gaps, and as a secondary
objective, highlighting its importance for adaptation of law to social conformations. The study is an eminently qualitative research. The
construct was guided by the premise that the existence of gaps is an opportunity to renew to the law, investigating the interpretation of social
facts and humanizing legal practice. Both the review and the views of the authors converged on the understanding that the prediction of these
methods tend to make the application of law in an efcient reality. In addition, the resources available to the magistrate’s interpretation and the
critical and careful customs observation expand its discretion scope, redening the personal and circumstantial factors.
