Lei da Ficha Limpa – Lei nº 135/2010

Resumo
O presente estudo teve como objetivo apresentar uma análise sobre a Lei
Complementar 135/10 conhecida como a Lei da Ficha Limpa, que introduziu novas
hipóteses de inelegibilidades na Lei complementar nº 64/90, Lei das Inelegibilidades,
e com isto trouxe profundas transformações nas condições jurídicas de acesso aos
cargos eletivos no Brasil. Neste estudo, examina-se o contexto legal e os históricos
que antecederam o projeto de iniciativa popular que viria a se tornar a Lei nº 135/10,
Lei da Ficha limpa, abordando desde seu surgimento, os conflitos enfrentados como as
inelegibilidades e suas causas e recursos da decisão. Por fim, foram escolhidos dois
temas, dentre muitos outros, que geraram muita polêmica em relação às inelegibilidades
trazidas pela Lei da Ficha Limpa, o princípio da Presunção de Inocência, e a Inelegibilidade
motivada da Renúncia a Mandato para fugir da Cassação.

Abstract
The present study aimed to present an analysis of Complementary Law 135/10
known as the Clean Registry Act, which introduced new hypotheses of ineligibility in
the Complementary Law 64/90, the Law of Ineligibilities, and with this brought profound
transformations in the legal conditions Access to elected positions in Brazil. This study
examines the legal and historical context that preceded the project of popular initiative
that would become Law 135/10, Clean Sheet Law, addressing since its inception, the
conflicts faced as the ineligibilities and their causes and Resources of the decision.
Finally, two themes were chosen, among many others, that generated much controversy
regarding the ineligibility brought by the Clean Tab Act, the principle of the Presumption
of Innocence, and the motivated Ineligibility of Renunciation of Mandate to flee Cassation.
