O território brasileiro foi, e ainda é,
objeto de interesses estrangeiros, tendo
em vista sua vasta riqueza natural. A
Constituição da República Federativa
do Brasil prevê uma norma de ecácia
limitada sobre a aquisição ou o
arrendamento de propriedade rural por
pessoa física ou jurídica estrangeira,
cabendo à legislação infraconstitucional
sua regulamentação. Um dos objetivos
deste trabalho é avaliar se no cenário
jurídico atual seria possível a aquisição de
terras brasileiras por estrangeiros, além
de vericar se a nova regulamentação
proposta pelo Projeto de Lei n.
2.963/19, caso transformada em lei,
poderá impactar em danos ambientais
negativos e irreversíveis ao Brasil, em
especial ao território amazônico. Foi
utilizada a metodologia hipotética
dedutiva, conrmando-se a hipótese
levantada, na qual o surgimento de
novos empreendimentos privados
estrangeiros, com a exibilização da
legislação vigente, poderá aumentar a
degradação ao meio ambiente, embora
exista a possibilidade teórica de que haja
melhoras em aspectos socioeconômicos
do País. Tal fato afeta diretamente
a conservação do ambiente natural
e impacta em sérias e irreversíveis
consequências à Amazônia brasileira,
bem como todo território nacional.

IMPACTS ON THE ENVIRONMENT: A CRITICAL
LOOK TOWARDS THE PROTECTION OF THE
AMAZÔNIA
Abstract
e Brazilian territory has been the
object of foreign interests, in view of
its vast natural wealth. e Federal
Constitution of Brazil provides a limited
eect legal rule about the acquisition
or lease of rural properties by a foreign
person or legal entity, which the
infraconstitutional legislation is the
responsible of that regulation. One of the
objectives of this work is to evaluate in
the current legal scenario the acquisition
of Brazilian land by foreigners is possible,
in addition to verifying whether the
new regulation proposed by Bill No.
2.963/19, if transformed into law, it
may impact on negative and irreversible
environmental damage to Brazil,
especially to the Amazon territory. e
hypothetical deductive methodology was
used, conrming the hypothesis raised,
by which the emergence of new foreign
private enterprises with the relaxation
of the current legislation may increase
the degradation to the environment,
although there is a theoretical possibility
of improving the country’s socioeconomic
aspects. is fact directly aects the
conservation of the natural environment
and impacts on serious and irreversible
consequences for the Brazilian Amazon,
as well as the entire national territory.
