Santos, Carlos Victor Nascimento. O Supremo de “portas abertas”: a
colegialidade em ação
Resumo: O presente artigo mapeia o tratamento da literatura a respeito
da colegialidade no Supremo Tribunal Federal e utiliza um conjunto de
métodos novos para investigar o tema. Posteriormente, foram utilizadas
entrevistas concedidas pelos ministros do Supremo para destacar o modo
como veem a colegialidade ou como gostariam que ela fosse vista e regis-
trada. Por fim, realizou-se um trabalho etnográfico nas sessões de julga-
mento do Supremo Tribunal Federal por um período de dois anos a fim
de desconstruir a categoria investigada e destacar a colegialidade em ação.
Em resumo, a pesquisa se utiliza de múltiplos métodos para destacar o
“direito nos livros”, “o direito no discurso” e “o direito em ação”. O que
permitiu, dentre outras questões, identificar a existência de uma rotina na
elite judiciária investigada, capaz de reger suas próprias relações; além de
destacar a produção social do Direito no cotidiano das relações, instruídas
por elementos como o constrangimento e o processo de legitimação do
exercício de suas profissões.

Brazilian Supreme Court with “open doors”: collegiality in action
Abstract: This article represents a brief synthesis of research accomplished in
a PhD about the practice of collegiality in the Brazilian Supreme Court. The
first part reviews the treatment given by the existing literature to collegiality.
Afterwards, interviews granted by the Justices of the Brazilian Supreme Court
were used to highlight how they see the collegiality or how they would like it
to be seen and remembered. Lastly, the article presents an ethnography of the
Brazilian Supreme Court hearings for two years to deconstruct the category
and highlight collegiality in action. Briefly, the research uses several methods
to contrast the “law in the books”, “law in the speech” and the “law in action”.
This allowed the identification of a routine in the judiciary elite investigated,
a routine which was able to guide their relations; and to highlight the daily
social construction of law, instructed by elements as embarrassment and the
process of legitimation of the practice of their professions.
