Supreme Court confirms annulment of Lula da Silva's conviction

The plenary session of the Brazilian Federal Supreme Court (STF) confirmed on Thursday the decision of Justice Edson Fachin and annulled, by majority of votes, the condemnations imposed on former President Luiz Inácio Lula da Silva by the 13th Federal Court of Curitiba, making the Workers' Party leader once again able to run for elections. The score was 8 to 3.

Next week, the STF will still need to decide where Mr. Lula da Silva's four lawsuits should be sent to, whether to the Federal Court of the Federal District, as defended by Mr. Fachin, or to São Paulo, as suggested by Justice Alexandre de Moraes. The trial will resume on Thursday, after a national holiday.

Justices will also have to discuss the third and last appeal on the case. For Mr. Lula da Silva's defense, in spite of the annulment of the convictions, the other requests submitted to the Supreme Court related to the corruption investigation involving oil company Petrobras, known as Operation Car Wash, should continue to be processed. One of them is the habeas corpus petition filed by Mr. Lula da Silva saying that Sergio Moro, head-judge of the investigation, was biased. In practice, the Court will decide whether or not to uphold the decision of the Second Panel, which determined that Mr. Moro was not impartial in judging the former president in the case involving a triplex apartment in São Paulo coastal town of Guarujá.

On Thursday's judgment, the majority of justices consolidated the Court's understanding that criminal suits that do not deal with crimes committed directly and exclusively to the detriment of Petrobras do not "attract" the jurisdiction of Curitiba - a situation that applies to the four cases involving Mr. Lula da Silva...
