Ending perks in public service

The constitutional amendment proposal (PEC) that creates a new public administration eliminates ten perks that persist for servants. Some already had ended for federal servants, but continue existing for states' workers. They are:

* Bonus leave: servants' right to three-month leave for every five years worked. This benefit ended in 1999 for federal workers, but continues benefiting those of 20 of the 27 states;

* Retroactive pay raises: common practice at the three levels of government - federal, state and municipal - of making agreements for salary raises in the middle of the year that are retroactive to January, for example;

* Over 30 days of vacation per year: 60-day vacations are common in the judiciary, and the reach of this prohibition is related only to servants and not to members of the other branches. Therefore, judges and prosecutors, for example, are not affected by the PEC;

* Additional pay for time of service: this perk corresponds to a 1% salary increase annually, regardless of collective agreements, and reaches all servants. The practice also ended at the federal level in 1999, but continue in effect in several states;

* Compulsory retirement as punishment: This is a benefit travestied as punishment that has no parallel in any other place in the world. If the servant committed some type of wrongdoing, they are automatically retired, being paid the corresponding pension;

* Compensatory payments without legal provision will no longer exist;

* Additional pay or compensation for non-effective replacement: when the worker is left in standby for potential replacement that doesn't materialize, they receive an additional pay. The PEC ends with such remuneration;

* Reduction of working hours without pay reduction: every reduction of working hours will have to be matched by salary reduction, except if it is for health reason;

* Progression or promotion based exclusively on time of service: promotions that occur only because of time of service, without any performance assessment, end;

* Inclusion in the salary of extra pay related to posts: practice also very common of increasing the salary by adding to it commissions after five years of their receipt.

The PEC terms apply only to new workers who join the public service after the law and its regulation are enacted. It is extensive to servants of the three levels of government (federal, state and municipal) and of the three branches (executive, legislative and judiciary).
