Police seizes draft decree to change election result in former minister’s house

The Federal Police (PF) seized at the home of former Justice Minister Anderson Torres a draft presidential decree that would enable intervention in the Superior Electoral Court (TSE), which would have the potential to change the outcome of the October election in favor of former President Jair Bolsonaro, defeated re-election candidate.The information was revealed by the newspaper Folha de S.Paulo and confirmed by Valor with sources familiar with the matter. The seized material would have been prepared after the elections, in October 2022. The use of it for an eventual change in the electoral result would be unconstitutional, according to the newspaper.The purpose of the document was to decree a state of defense, something that would require a referendum of Congress, according to article 136 of the Federal Constitution. The article says that the president of the Republic can decree a state of defense "in specific and restricted locations" to "preserve or to promptly re-establish" the public order threatened "by serious and imminent institutional instability." The Constitution further states that this mechanism can be adopted provided that "the Council of the Republic and the National Defense Council" are heard.In recent years, Mr. Bolsonaro has repeated unfounded and unproven suspicions about the electoral system. During the election campaign, on more than one occasion he suggested that he would not accept the outcome of the election.The document was found after the execution of a search and seizure warrant at Mr. Torres’ residence in Brasília.
