The Facts.—Chinatti, an attaché at the Austrian Embassy in Rio de Janeiro, was sued by Aluizio Clark Ribeiro in respect of a guarantee given by him as guarantor in the matter of the rent of a house in that city. The action was challenged by Chinatti on the ground that, as a result of his position as a member of a foreign Embassy, he was immune from the jurisdiction of the Brazilian courts.
