Supreme Court expected to veto sale of Petrobras refineries

The Federal Supreme Court's Chief Justice Luiz Fux scheduled for Wednesday the judgment of a request seeking to block the sale of Petrobras refineries. There are already three votes against the government and sources say most justices will probably follow suit.Mr. Fux asked Tuesday the virtual hearing to be more deeply debated by justices because of how controversial the topic is.

Justices Edson Fachin (rapporteur), Ricardo Lewandowski and Marco Aurélio Mello had already voted to preliminarily block the purposeful creation of subsidiaries for state-run companies to circumvent the obligation to ask for approval of the legislative branch or to start a bidding process.

The case reached the court in July by request of Congress President, Senator Davi Alcolumbre (Democrats, DEM, of Amapá). He warned the court of an alleged government maneuver to make privatizations easier - a way to sidestep a decision the STF took last year.

The STF's plenary ruled then that the government was not required to ask for authorization from lawmakers to privatize subsidiaries, but parent companies were excluded from that ruling. Because of that ruling, the federal government is accused of breaking up parent companies to transfer their control to the private sector.

Senator Alcolumbre says a decision by the Supreme Court's is key to block any maneuver to sell Landulpho Alves Refinery in Bahia and President Vargas Refinery in Paraná. The sales are defended by the Bolsonaro administration's economic officials.

Petrobras has already been approached by companies interested in buying the refineries, sources familiar with the privatization talks say, but is still negotiating. The sale is expected to take...
