O DANO MORAL E O ENRIQUECIMENTO SEM CAUSA –
UTOPIA E DISTOPIA JURÍDICA

Resumo: Na formação de nosso povo; ainda com as caravelas aportadas em frente
ao Monte Pascal, já revelaram qual era o desiderato da esquadra Portuguesa.
Conquistar terras, minérios, madeira e calcificar um povo, tornando seus eminentes
súditos. Curiosamente, já com o Império/ Colonial, aqui passou a ser conhecido
como a "Terra do quinto dos Infernos", por conta das tributações de 20% por cento
do que se produzia (1/5). No entanto, estas jazidas eram aqui extraídas, e lá além-
mar era percebido. A Nação não fora germinada e adubada com os insumos
cognitivos, mas com a denotação patrimonialista, exploratória e sedimentária das
classes sociais com fortes amalgamas das iniquidades governamentais. Celebrar, a
presença do reconhecimento do instituto Jurídico que tomou grassa na população
como instrumento de reconhecimento dos seus idílicos Direitos, era impensável:
UTOPIA, e hodiernamente, os fundamentos jurídicos que tentam dar vida as
indenizações, o fazem com borrifadas que caracterizam a DESTOPIA.

Abstract: The formation of our people; still with caravels brought in front of Monte

recognition of the legal institute that took force in the population as an instrument of
recognition of its idyllic Rights was unthinkable: UTOPIA, and nowadays, the legal
