Os Direitos e Garantias Fundamentais

RESUMO: O presente trabalho trata dos Direitos e Garantias Funda-
mentais e tem o objetivo de conceituar tal direito, que tem por finalidade o
respeito ao ser humano, protegendo todos os indivíduos dos abusos que pos-
sam vir a cometer o poder estatal. O estudo desenvolvido tem como base o
método indutivo através da pesquisa bibliográfica, explicando a diferença
entre Direitos Humanos e Direitos Fundamentais, a classificação doutriná-
ria, a divergência entre Direitos e Garantias, bem como as características
dos Direitos Fundamentais no ordenamento jurídico.

ABSTRACT: The present work deals with the Fundamental rights and
guarantees and aims to conceptualize this right, whose purpose is the re-
spect for the human being, protecting all individuals from abuses that could
commit the State power. The study is based on the inductive method
through bibliographical research, explaining the difference between Human
Rights and fundamental rights, the doctrinal classification of Fundamental
rights and guarantees, the divergence between rights and guarantees, as well
as the classification and characteristics of fundamental rights in the legal
system.

INTRODUÇÃO
Os Direitos e Garantias Fundamentais são direitos inerente ao ser hu-
mano, que se referem aos direitos básicos individuais, políticos e sociais,
dando-lhes garantias quanto à vida, à liberdade, à igualdade, à segurança e à
propriedade.
As Liberdades Fundamentais são reconhecidas e positivadas no âmbito
do direito constitucional e definidos por um determinado estado (caráter
