(Re) Pensar os direitos humanos: do individuo à comunidade
Resumo: O artigo tem por objetivo apresentar a problemática teórica e política da coexistência de diversas concepções de
direitos humanos no contexto do multiculturalismo e da diversidade de lutas e resistências de grupos sociais subalternizados.
A tais efeitos o texto descreve em primeiro lugar a matriz hegemônica da tradição jurídica ocidental, para seguidamente
expor algumas das críticas à sua insuficiência e ao seu caráter colonizador. Seguidamente apresenta duas p erspectivas sobre
os direitos humanos de fronte a realidades multiculturais, estas são as a nálises de Boaventura de Sousa Santos e de Raimon
Panikkar. Ambos os autores partem da realidade do pluralismo cultural e da necessidade de estabelecer ca minhos possíveis
de diálogo entre as diferentes concepções de mundo com a finalidade da defesa dos direitos humanos. No caso de Sousa o
autor acredita na possibilidade da “tradução intercultural”, por sua vez Panikkar defende o “diálogo intercultural”.

(Re)Thinking human rights: from the individual to the community
Abstract: The article aims to present the theoretical and political problem of the coexistence of different conceptions of
human rights in the context of multiculturalism and the diversity of struggles and resistance of subaltern social groups. For
these purposes, the text first describes the hegemonic matrix of the We stern legal tradition, and then exposes some of the
criticisms of its insuffi ciency and its colonizing character. It then presents two perspective s on huma n rights fa cing multicultural
realities, these are the analyzes of Boaventura de Sousa Santos and Raimon Panikkar. Both authors start from the reality of
cultural pluralism and the need to establish possible paths of dialogue between the d ifferent conceptions of the world with
the aim of defending human rights. In the case of Sousa, the author believes in the possibility of “intercultural translation”,
while Panikkar defends “intercultural dialogue”.
