RESUMO: Este presente artigo demonstra os elementos e dificuldades
acerca do reconhecimento dos direitos dos transexuais sob o prisma da dig-
nidade humana. Dignidade esta interpretada sob a ótica que a entende como
uma mistura entre um valor intrínseco de cada ser humano com a autonomia
pessoal. Na primeira parte apresenta a letra da lei e as dificuldades quando
feita uma interpretação literal para a possibilidade de cirurgia de transgeni-
talização ainda que esta assegurada pelo O Enunciado 276 da IV Jornada de
Direito Civil. Em seguida são apresentados alguns direitos das pessoas tran-
sexuais: direito ao nome, direito reprodutivo e com mais destaque ao direito
à disposição do próprio corpo; bem como feitas desconstruções do termo
“sexo” feminino e masculino ressignificando a palavra e a despatologização
com o fim do termo “transexualismo”. Além disso, demonstrados avanços
significativos no Brasil no que diz respeito aos direitos dos transexuais, mas
ainda deixando a desejar no que se refere às exigências preconceituosas para
a realização da cirurgia de transgenitalização.

ABSTRACT: This article shows the elements and difficulties around
the knowledge of transsexual rights under the vision of human dignity. That
dignity is interpreted as a mix of intrinsic value and personal autonomy. At
the very first part it reveals the letter of the law and its difficulties when
litteraly interpreted for the possibility of doing the transgenitalization sur-
gery even its assured by the Statement 276 of the IV Civil Right Journey.
After that its shown some transsexual valuable rights: name right, reproduc-
tive right and its given emphasis on the right of disposition of the own body;
as well as the end of the term “transexualismo” used to put an idea of a dis-
ease and resignifying the meaning of the word in Portuguese “sexo” refer-
ring to male and female genders. Beyond that, it reveals some significative
brazilian advances on transsexual rights but still letting us thinking about the
requirements of the surgery wich are very prejudiced.
