Resumo
O tema do presente trabalho é o jul-
gamento de Jean-Pierre Bemba Gombo
perante o Tribunal Penal Internacional
e a possibilidade de uma parte geral, no
que tange ao direito Penal Internacio-
nal. Como objetivo especíco, tem-se o
exame da gura do superior hierárqui-
co na estrutura do Estatuto de Roma e
a aplicação dessa gura jurídica para a
primeira sentença e eventual decisão do
recurso feito à corte pelo congolês. A
pesquisa que se propõe pertence à ver-
tente metodológica jurídico-sociológi-
ca. Com relação ao tipo de investiga-
ção, foi escolhido o jurídico-projetivo.
O raciocínio desenvolvido na pesquisa
será predominantemente dedutivo.
Concluiu-se, da presente pesquisa, que
a apreciação da sentença e do recurso
foram antagônicos no que diz respei-
to aos elementos de caracterização do
superior hierárquico e, consequente-
mente, no adimplemento de uma parte
geral do Direito Penal Internacional.
Isso porque a primeira contou com a
consolidação dos elementos necessários
para o crime comissivo por omissão, ao
passo que a decisão do recurso rediscu-
tiu a matéria entendendo pela não ob-
servação dos elementos anteriormente
sopesados.

Abstract
Te subject of research is the trial of
Jean-Pierre Bemba Gombo before the
International Criminal Court and the
possibility of a general part, regarding
International Criminal Law. As a spe-
cic objective, there is the examination
of the gure of the hierarchical superior
in the structure of the Rome Statute and
the application of the legal gure for the
rst sentence and eventual decision of the
appeal made to the court by the Congo-
lese. e proposed research belongs to the
juridical-sociological methodological as-
pect. Regarding the type of investigation,
the legal-projective type was chosen. e
reasoning developed in the research will
be predominantly deductive. It was con-
cluded from the present research that the
sentence and the appeal were antagonis-
tic regarding the elements of characteri-
zation of the hierarchical superior and,
consequently, in the fulllment of a gen-
eral part of International Criminal Law.
e rst relied on the consolidation of the
necessary elements for the commission of
crime by omission, while the decision of
the appeal re-discussed the matter, under-
standing the non-observation of the pre-
viously overweight elements.
