Resumo: A partir do estudo da obra Ser e tempo, de Martin
Heidegger, obra que, por ser uma obra de Fenomenologia
Hermenêutica, isto é, de Ontologia, estuda os modos de ser
dos entes, procura este trabalho determinar o modo de ser
do direito. Em Ser e tempo são descritos três modos possíveis
dos entes se mostrarem em seu ser: i) o modo de ser da coisa,
que se refere ao mostrar-se dos entes para a atitude teórica
no modelo das Ciências da Natureza; ii) o modo de ser do
manual, que se refere ao mostrar-se dos entes à atitude do
homem na lida prática com o mundo. Atitude que pode ser
compreendida discursivamente por uma Hermenêutica; iii)
o modo de ser da cura, modo como se mostra o homem.
Este é compreendido pela Fenomenologia Hermenêutica de
Heidegger, que pode ser desenvolvida por uma Antropologia
compreendido como possuindo o modo de ser da cura. As
consequências desta compreensão também são trabalhadas.

Abstract: Based on a study of the work Being and Time by Martin
Heidegger which, as a work of Hermeneutic Phenomenology, i.e.
Ontology, studies the ways of being of beings, this work seeks to
determine the way of being of the law. Being and time describes
three possible ways in which beings manifest themselves in
their being: i) the way of being of the thing, which refers to the
manifestation of beings for the theoretical attitude in the model
of Natural Sciences; ii) the way of being of the manual, which
relate to the manifestation of beings to the attitude of man in
his practical dealings with the world - an attitude that can be
understood discursively by Hermeneutics; and iii) the way of
the being of cure; the way in which man manifests himself. This
is understood by Heidegger’s Hermeneutical Phenomenology,
which can be developed by a Philosophical Anthropology.
