Resumo: O presente artigo procura investigar a relação, no âmbito do pro-
cesso penal, entre o instituto da coisa julgada e as decisões de arquivamen-
to do inquérito policial, estudando, em particular, as principais modicações
promovidas pelo Pacote Anticrime. De início, fazem-se imprescindíveis alguns
apontamentos sobre a coisa julgada no processo penal, discorrendo também
sobre o procedimento de arquivamento do inquérito policial antes e após a
Lei n. 13.964/2019. Valendo-se de revisão bibliográca e de análise legislativa
e jurisprudencial, essa pesquisa aborda o arquivamento do inquérito à luz da
legislação processual, com base também nas considerações doutrinárias. Ao ar-
remate, necessário reconhecer que o novo procedimento instituído pelo Pacote
Anticrime, cuja vigência se encontra suspensa por ordem do Supremo Tribunal
Federal, acaba por afastar a coisa julgada que revestia as decisões de arquiva-
mento do inquérito policial.

Abstract: This article seeks to investigate the relationship, within the scope of
criminal procedure, between the institution of res judicata and the decisions to
archive the police investigation, studying, in particular, the main changes pro-

moted by the Anticrime Package. At rst, it is essential to make some notes on res
judicata in the criminal procedure, also discussing the procedure for archiving the
police investigation, before and after Law n. 13.964/2019. Based on bibliographic
review and legislative and jurisprudential analysis, this research addresses the closu-
re of the investigation in the light of procedural legislation, also based on doctrinal
considerations. At the end, it is necessary to recognize that the new procedure ins-
tituted by the Anticrime Package, whose effectiveness is suspended by order of the
Federal Supreme Court, has removed the res judicata that covered the decisions to
archive the police investigation.
