RESUMO: Este trabalho busca compreender a conformação das políticas municipais de
preservação do patrimônio nas cidades de Minas Gerais a partir das bases legais
redistribuição do ICMS patrimônio cultural nela prevista. Neste sentido, é apresentado
um estudo de caso do município de Barão de Cocais, que enfrenta inéditas demandas
para preservar o patrimônio edificado e imaterial no distrito de Socorro, ameaçado pelo
rompimento da Barragem Sul Superior. De tais demandas, emerge a necessidade da
revisão da legislação municipal de proteção ao patrimônio, que se mostra ineficiente
para a preservação do acervo existente no distrito ameaçado pela chamada ‘lama
invisível’, que motivou a evacuação do distrito e que causou danos indiretos ao
patrimônio material e imaterial.

ABSTRACT: This paper wants to understand the conformation of municipal politics
for the preservation of heritage in the cities of Minas Gerais, starting from the legal
bases established in the federal constitution of 1988, especially from the politics of
redistribution of the ICMS cultural heritage provided for in it. In this sense, a case study
of the municipality of Barão de Cocais is presented, which faces unprecedented
demands to preserve the built and immaterial heritage in the district of Socorro,
threatened by the rupture of the South Superior Dam. From these necessities, the
requirement for the revision of municipal legislation on the protection of heritage
emerges, which proves inefficient for the preservation of the existing collection in the
district threatened by the so-called 'invisible mud', which motivated the evacuation of
the district and caused indirect damage to material and immaterial heritage.
