Resumo
John Henry Merryman, em seu livro de 1969, afirmou que
existem, globalmente, três tradições jurídicas altamente
influentes no mundo: Civil Law, Common Law e o direito
socialista. Desde a queda da União Soviética, a maioria dos
juristas comparatistas abandonou a ideia do "direito
socialista" como uma tradição jurídica distinta. Este texto
argumenta que, duas décadas após a "transição", a tradição
nos países pós-socialistas ainda tem características que são
distintas tanto do Civil Law como do Common Law,e pode,
portanto, ser tomada como uma "tradição jurídica" autônoma.
Abstract
John Henry Merryman in his 1969 book claimed that there
are, globally, three highly influential legal traditions in the
world: civil law, common law, and socialist law. Since the fall
of the Soviet Union, most comparative lawyers have
abandoned the idea of the "socialist law" as the separate
legal tradition. This text argues that, two decades after the
"transition", the tradition in post-Socialist countries still has
features that are distinctive from both civil and common law,
and may therefore be taken as a separate, "third" legal
tradition.
