1 INTRODUÇÃO
A questão do urbanismo no Brasil foi retardada sobremaneira
até alcançar a preponderância necessária para ser considerada de interesse
constitucional. Contudo, quando inserida no texto da Carta Magna rece-
beu, como é de praxe do legislador agora mais atento, uma série de inter-
relacionamentos com fulcro contínuo no interesse social, dizer-se-ia, ainda
preocupada que esse interesse detivesse um cunho ambiental, segundo o
inovador art. 225.
Dentro desses meandros legais, o tema agiganta-se tomando
como base outros ramos da ciência jurídica para ser seu alicerce, concitan-
do um sistema que integra desde a União Federal, com suas prerrogativas e
obrigações, até o mais simples dos particulares, sem afastar a responsabili-
dade de ninguém dentro da questão urbanístico-ambiental.
URBAN LAW AND THE CHALLENGE OF SUSTAINABLE ADMINIS-
TRATION IN THE COUNTY
ABSTRACT
The present study intends to highlight how Urban Law has contributed
to the challenge of the sustainable environmental administration in the
county. It approaches the progressive urban aspect in the constitutional
text throughout the time. It deals with the Cities Statute and the tools of
and political tools. It also analyzes the previous studies of environmental
-
tration used by public manager, which are according to the law 10.257/01.
it also presents the legal basis for ground division and ground limitation
as positive aspects for re-ordination of public areas. It exposes the need
for the public manager to commit to the reorganization of urban areas for
the sustainability of the cities. In order to reach such goals, the descriptive
method in quantitative research with documental and bibliographic appro-
ach was used.
