RESUMO: O artigo analisa os substratos materiais e formais que c onferiram, aos trabalhos da
Assembleia Nacional Constituinte de 1987-1988, a abertura, o desenvolvimento e a sedimentação da
salvaguarda dos direitos animais no ordenamento constitucional brasileiro, a partir da regra-motriz
de vedação à crueldade. Sob o recorte histórico de maturação do ambientalismo no país, somado às
predileções dos movimentos de proteção animal, envereda-se pelos trabalhos iniciais da Assembleia
Nacional Constituinte, cujos debates animalistas se centraram na Subcomissão de Saúde, Seguridade
e Meio Ambiente. Na sequência, preza-se por uma análise mais detida das linhas de força em disputa
sobre o locus que os animais ocupar iam na carta política em c onstrução, esquadrinhando parcela dos
atos da Frente Nacional de Ação E cológica e as sugestões de congressistas, do terceiro setor e de
cidadãos acerca de um regime jurídico atento (ou não) às demais espécies. Por fim, o texto avança
pelos desdobramentos dados à Assembleia Nacional Constituinte até a confecção de seu produto
final: o artigo 225, § 1º, VII, da Lei Maior. Para t anto, a investigação recorre à pesquisa qualitativa,
com a adoção dos procedimentos metodológicos da pesquisa bibliográfica e da análise documental
de fontes primárias. Conclui-se que as mobilizações orquestradas pela sociedade civil, conjugadas às

tentativas de parlamentares de fortalecimento dos grupos de interesse atuantes na Constituinte,
garantiram aos animais a titularização de direitos e a programação de vetores animalistas, ainda que
sob as ameaças do poder constituinte derivado. Eis a sagração do constitucionalismo animal
brasileiro.

ABSTRACT: The article analyzes the material and formal substrates that conferred, to the work of the
National Constituent Assembly of 1987- 1988, the opening, the development and the sedimentation
of the protection of animal rights in the Brazilian constitucional order, from the driving rule of the
prohibition to cruelty. Under the historical cut-out of the maturation of environmentalism in the
country, added to the animal protection movement's predilections, it goes through the initial works
of the National Constituent Assembly, whose animalist debates were c entered in the Subcomission of
Healthy, Security and Environment. In the sequence, a more detailed analysis is made of the power
lines in dispute about the position that animals would occupy in the political charter under
construction, by going t hrough some of the acts of the so-called National Front Ecological Action and
the suggestions from congress members, from the third sector, and from citizens about a legal regime
attentive (or not) t o other species. Finally, the text moves forward through the developments that
took place in the National Constituent Assembly until the confection of its final product: the article
225, 1, VII, of the Brazilian Constitution. To t his end, the investigation is conducted through
qualitative research, with the adoption of the methodological procedures of bibliographic research
and documentary analysis of primary sources. In conclusion, the mobilizations orchestred by the civil
society, conjugated to the attemps of parliamentarians to strengthen the active interest groups in the
Constituent, guaranteed to the animals the titularization of rights and the programming of animalist
vectors, even if under the threats of the derivative constituent power. Here comes the sacredness of
the Brazilian animal constitucionalism.
