Abstract
[Purpose]
The purpose of the undertaken resea rch is to, in light of the Regulato ry State’s
premises o f fundamental righ ts guarantee and subsidiarity, analy ze the standstill o f the
audiovisual sec tor’s fostering by the National Film Ag ency (ANCINE) as of 2018,
considering the prior itization of the monitoring function as a means to reverse the
previous disp ensation of resources ab ove the entity’s operatio nal capacity.
[Methodology /approach/de sign]
The c hosen approach starts w ith two premises of the
Regulatory State, which are th en related to the p ublic function of fo stering, focusin g on
the institu tional experience o f the audiovisual sector between 20 18 and 2020, wh en the
concern of controlling organs regarding ANCINE, in addition to th e overru n of the
Agency’s operational c apacity, culminate d in prioritization o f the moni toring over the
fostering func tion.
[Findings]
The research highlights the need for balance between the d ifferent functions
and activities of the Regulato ry State – in this case, between the monitor ing and fostering
activities –, a t the risk of not fulfillin g the very fundamental rights it aims to guarantee .

Regulador de garantia de direitos fundamenta is e de su bsidiariedade, analisar a
paralisação do fomento ao setor audiovisua l pela Agência Nacional do Cine ma
(ANCINE) a partir de 2018, tendo em vista a priorizaçã o de sua função fiscalizatória com
