Resumo: O trabalho investiga o papel efetivo das Leis n.
13.874/2019 (“Lei de liberdade econômica” – LLE) e n.
14.010/2020 (“Regime jurídico emergencial e transitório das
relações jurídicas de Direito Privado” – RJET) no que tange às
normas restritivas de revisão judicial de contratos aplicáveis no
contexto da pandemia. Por meio de método dedutivo, coteja-se o
teor dessas iniciativas com a experiência jurídica consolidada no
Brasil nesse tema e com avaliação qualitativa e quantitativa de
decisões judiciais, de modo a avaliar a pertinência de reconduzi-
las à categoria da chamada “legislação simbólica”, isto é, voltada
a produzir efeitos mais no plano retórico-ideológico do que
jurídico-normativo.

Abstract: The paper investigates the effective role of Laws
n. 13.874/2019 (“Law of Economic Freedom” – LLE) and n.
14.010/2020 (“Emergency and transitional legal regime of legal
relations of private law” - RJET) regarding restrictive rules for
judicial review of contracts applicable during the pandemic.
Through deductive method, the content of these initiatives is
compared with the legal experience consolidated in Brazil in this
theme and with qualitative and quantitative evaluation of judicial
decisions, in order to evaluate the pertinence of considering them
“symbolic legislation”, that is, aimed at producing effects more
in the rhetorical-ideological field than legal-normative field.
