Resumo:
Contextualização
o poder exclusivo do Estado de criar o seu direito. Todavia, na atualidade, essa ideia começa a
perder fôlego dando lugar a novas institucionalidades estabelecidas por meio de mecanismos de
governança e soft law.
Objetivo: Através dos itinerários percorridos pela soberania para a evolução do seu conceito,

compreender como e em que medida o jogo de forças entre soberania e governança as transforma.
Metodologia
Resultado: Revela-se uma incompatibilidade entre o cabedal teórico existente sobre a soberania
                 

um novo entendimento com a soberania estatal democrática.

Resumen:
Contextualization
the exclusive power of the state to create its own law. However, nowadays, this idea is beginning to
give way to new institutionalities, established through mechanisms of governance and soft law.
Objectives: Through the routes taken by sovereignty for the evolution of its concept, this work
analyzes this theoretical construction, seeking to identify contemporary sovereignty, in order to
understand how, and to what extent it is transformed by the interplay of forces between sovereignty
and governance.
Methodology: The research uses a deductive method and a the procedure of bibliographical review.
Result: It is revealed an incompatibility between the existing theoretical framework on sovereignty
                
demonstrating that alongside the State, other subjects are beginning to compose sovereignty, leading
to a new understanding with democratic state sovereignty.

ABSTRACT:
Contextualización: Según la literatura tradicional, la soberanía indica poder, en concreto, el poder
exclusivo del Estado para crear su derecho. Sin embargo, hoy en día, esta idea está empezando
a perder fuerza, dando paso a nuevas institucionalidades establecidas a través de mecanismos de
gobernanza y de derecho indicativo.
Objetivo: A través de los itinerarios recorridos por la soberanía para la evolución de su concepto, se

entender cómo y en qué medida el juego de fuerzas entre soberanía y gobernanza las transforma.
Metodología
Resultado: En este contexto, se percibe que el concepto de soberanía y de gobernanza se ha
transformado, revelando una incompatibilidad entre el marco teórico existente sobre la soberanía
               
      
rmando un nuevo entendimiento con la soberanía estatal democrática.
