THE FAZENDA BRASIL VERDE CASE

RESUMO: O estudo parte da atualidade e importância da temática relacionada ao trabalho
decente e prevenção e repressão de trabalho forçado, bem como aquele realizado em condições
degradantes ou análogas à de escravo. Examinando a decisão emitida pela Corte Interamericana
de Direitos Humanos no caso Fazenda Brasil Verde, procura-se, por meio de uma análise dos
instrumentos utilizados para embasar a configuração do trabalho escravo contemporâneo,
examinar como a interpretação integrada a partir do cenário internacional de normas sobre o
tema possibilitou a superação das imprecisões presentes no conceito de escravidão. Busca-se,
com a pesquisa, entender como as normas internacionais podem ser utilizadas pelo intérprete
do Direito para fundamentar decisões que tutelem e preservem os direitos fundamentais sociais.
No caso sob análise, o ponto medular da decisão exigia o enquadramento dos fatos no conceito
de “trabalho escravo”. Para tal exercício, valeu-se a Corte, superando a imprecisão dos termos,
da reunião de diversas normas internacionais que, mantendo a plasticidade do instituto,
dotaram-lhe de concretude capaz de permitir sua incidência diante do caso concreto. Ganha
relevo o exercício interpretativo da Corte, uma vez que direitos sociais foram tutelados a partir
de uma Declaração, cujo objetivo inicial era a proteção de direitos civis e individuais. O artigo
examina a decisão da Corte Interamericana de Direitos Humanos sob a perspectiva da
interpretação jurídica e traça possíveis diálogos entre o tratamento da temática dada ao Caso
Siliadin, marco europeu no reconhecimento da escravidão moderna.

ABSTRACT: The study is based on the actuality and relevance of the issues related to decent
work and the prevention and repression of forced labor, as well as those carried out in degrading
or slave-like conditions. Examining the decision issued by the Inter-American Court of Human
Rights in the Fazenda Brasil Verde case, it is sought, through an analysis of the instruments
used to support the configuration of contemporary slave labor, to examine how the integrated
interpretation based on the international scenario of norms about the theme made it possible to
overcome the imprecisions present in the concept of slavery. The research seeks to understand
how international norms can be used by the interpreter of the right to base decisions that protect
and preserve fundamental social rights. In the case under analysis, the central point of the
decision required the framing of the facts in the concept of "slave labor". For this exercise, it
was necessary the Court, overcoming the imprecision of the terms, from the meeting of several
international norms that, while maintaining the plasticity of the institute, endowed it with
concrete capable of allowing its incidence in the concrete case. The Court's interpretive exercise
is highlighted, since social rights were protected from a Declaration, whose initial objective
was the protection of civil and individual rights. The article examines the decision of the Inter-
American Court of Human Rights from the perspective of juridical interpretation and outlines
