THE PROBLEM OF UNREGULATED FISHING: THE EXTINCTION OF SPECIES AND
THE PRODUCTION OF GARBAGE - HOW TO RESPONSIBLE AGENTS AND REPAIR
THE DAMAGE

RESUMO: O estudo abordará como a atividade pesqueira tem sido praticada de forma
insustentável ao redor do mundo, devido à falta de regulamentação, fiscalização e
punição. Nesse sentido, serão demonstradas as principais causas de destruição do
ambiente marinho pela pesca industrializada, e, especificamente, sobre o método da
pesca de arrasto e normalização da pesca acidental (bycatch). Posteriormente, serão
abordadas as principais consequências da pesca não regulamentada, entre a extinção de
espécies e a produção de lixo plástico. Em sequência, serão estudadas as possibilidades
de responsabilização de Estados e de indivíduos sobre tais danos ambientais, e,
consequente obrigação de reparação. Para concluir, é importante definir soluções
aplicáveis ao Direito Internacional e aos Nacionais, visando a postulação de legislações
que limitem certos aspectos abusivos da pesca como é realizada hoje, para que, após,
seja possível fiscalizar e responsabilizar as práticas ilegais.

ABSTRACT: The study will seek to approach how the fishing activity has been
practiced in an unsustainable way around the world, due to the lack of regularity,
inspection and punishment. In that regard, will be discussed the main causes of the
destruction of the marine environment by industrialized fishing, and, specifically, on the
method of trawling and the normalization of accidental fishing (bycatch). Then, the
main consequences of unregulated fishing will be addressed, between the extinction of
species and the production of plastic waste. Subsequently, the possibilities of making
States and individuals liable for such environmental damage will be studied, and,
consequently, the obligation to make reparation. To conclude, it is important to define
the solutions applicable to International Law and National laws, aiming at the
postulation of laws that limit certain abusive aspects of fishing as it is done today, so
that, later, it is possible to inspect and hold illegal practices accountable.

1. Introdução
A preservação da vida nos oceanos é indispensável para a manutenção da vida
humana no planeta. A preservação desse bem natural está relacionada não só ao aspecto
ambiental, mas diretamente, com os aspectos sociais e econômicos. Segundo o site
