Resumo: Este artigo tem como fim retratar a evolução dos direitos
fundamentais ao longo do tempo e seu reconhecimento perante o Estado
como um direito constitucionalmente garantido. A dignidade humana
como um parâmetro para a aplicação prática dos direitos fundamentais na
sociedade brasileira contemporânea sob o aspecto da Constituição de 1988
e os princípios constitucionais penais que regulam os direitos dos
condenados, garantindo a estes a dignidade humana que é devida a todos
os sujeitos.

Abstract: This article will seek to portray the evolution of fundamental
rights over time, and the recognition of it by the State as a right
constitutionally guaranteed. The human dignity as a parameter for the
practical application of fundamental rights in contemporary Brazilian
society under the view of the Constitution of 1988 and the constitutional
principles of criminal law that regulates the rights of the condemned,
guaranteeing them the human dignity that is due to all individuals.
