NECESSARY FEDERATIVE REPACTUATION

RESUMO
O presente artigo faz uma análise do sistema federativo brasileiro comparan-
do-o com o sistema norte-americano, local de seu surgimento, e busca de-
monstrar a falha em sua formação, desde a origem, que acaba por prejudicar
Estados e municípios, visto concentrar poderes na União, deixando pouca
liberdade de auto-organização e autogoverno a Estados e municípios, traço
fundamental do regime federativo.

ABSTRACT
is article analyzes the Brazilian federal system comparing it with the North
American system, where it emerged, and seeks to demonstrate the failure of its
formation, from the origin, which ends up harming states and municipalities,
since it concentrates powers in the Unity, leaving little freedom of self-
organization and self-government to States and municipalities, a fundamental
feature of the federative regime.
