RESUMO
O protagonismo da vontade dos povos acima da soberania. Este é um dos
principais pilares do pensamento crítico de Luigi Ferrajoli. A presente reflexão
busca alinhar a junção contemporânea de soberania dos Estados e a regulação do
Direito, trazendo, no entanto, os sujeitos para dentro da narrativa, tirando-os do
lugar de passivos que aderem à norma imposta, para efetivos cidadãos
corresponsáveis pela regulação dos Estados soberanos, não o atual inverso.

ABSTRACT
The protagonism of the will of the people above the sovereignty. This is
one of the main pillars of the critical thinking of Luigi Ferrajoli. The present
reflection seeks to align the contemporary junction of sovereignty of the States and
the regulation of the Right, bringing, however, the subjects within the narrative,
taking them from the place of liabilities that adhere to the imposed norm, to
effective citizens responsible for the regulation of the Sovereign states, not the
current reverse.
