REFLEXOS DO MÍNIMO EXISTENCIAL NAS PROPOSTAS DE
REFORMA TRIBUTÁRIA

Resumo: O direito ao mínimo existencial representa o núcleo dos direitos
fundamentais, composto pela dignidade da pessoa humana e pelas
condições materiais para o exercício da liberdade, inclusive o direito ao
desenvolvimento humano. O poder estatal de tributar não pode avançar o
espectro do direito ao mínimo existencial, cujo status negativo dá-se
através das imunidades, ao mesmo tempo em que deve buscar a justiça
fiscal mediante a implementação de prestações positivas e um sistema
tributário progressivo, com respeito ao mínimo existencial e à capacidade
contributiva. As reformas tributárias que atualmente tramitam perante o
Poder Legislativo guardam algumas características relativas à proteção do
mínimo existencial, porém, ainda merecem reparos para o atendimento dos
preceitos constitucionais concernentes, ao mesmo tempo em que revelam
propostas para a tributação sobre o consumo que transcendem a espécie
tributária que se pretende veicular.

Abstract: The right to basic conditions of life represents the core of
fundamental rights, consisting of the dignity of the human person and the
material conditions for the exercise of freedom, including the right to
human development. The state power to tax cannot advance the spectrum
of the right to basic conditions of life, whose negative status is given
through immunities, while at the same time it must seek tax justice through
the implementation of positive benefits and a progressive tax system, with
respect to the right to basic conditions of life and to the ability to pay
principle. The tax reforms that are currently being processed by the
