Resumo: Este artigo se originou à partir da análise do livro intitulado A soberania
no mundo moderno - Nascimento e crise do Estado nacional, importante obra do
autor Luigi Ferrajoli, respeitado jurista italiano e um dos principais teóricos do
Garantismo. É apresentada a degradação do antigo princípio da soberania, com o
desenvolvimento do tema sendo exposto com a apresentação da evolução do estado
de direito existente nos ordenamentos jurídicos nacionais, com ampliações de
abordagens acera do nascimento da Organização das Nações Unidas - ONU, o
fenômeno da globalização, integração econômica, política e cultural, responsáveis
pela dissolução do clássico princípio da soberania. A conclusão da presente pesquisa
apresenta orientações acerca de soluções para o desenvolvimento do conceito de
soberania.

Abstract: This article originated from the analysis of the book entitled Sovereignty
in the Modern World - Birth and Crisis of the National State, an important work
of the author Luigi Ferrajoli, respected Italian jurist and one of the leading
theoreticians of Garantism. It presents the degradation of the old principle of
sovereignty, with the development of the subject being exposed with the
presentation of the evolution of the rule of law existing in the national legal systems,
with extensions of approaches to the birth of the United Nations - UN, the
phenomenon of globalization, economic, political and cultural integration,
responsible for the dissolution of the classic principle of sovereignty. The
conclusion of the present research presents orientations about solutions for the
development of the concept of sovereignty.
